European Commission seeks feedback on draft guidelines for high-risk AI classification

The European Commission has launched a consultation on draft guidelines concerning the classification of high-risk AI systems under the EU AI Act.

This development is important because the classification of AI systems is one of the practical foundations of the EU AI Act's risk-based approach. Organizations deploying or developing AI systems need to understand whether their use cases may fall into high-risk categories and what governance, documentation, oversight and risk management expectations may follow.

For organizations, this reinforces the need to structure internal AI governance around several practical questions:

  • Which AI systems are currently being used?
  • What business processes do they support?
  • Could any use cases fall into high-risk areas?
  • Is there appropriate documentation and accountability?
  • Are human oversight and data protection considerations addressed?
  • The consultation illustrates that AI governance is becoming increasingly operational. It is no longer only a legal or technical topic, but also a matter of inventory, classification, internal processes and organizational readiness.

    Organizations should monitor the final version of the guidelines and verify implications with official EU sources and qualified legal counsel where required.
